Community Gateway Association Ltd v Beha Williams Norman Ltd

Nature of case:
Beha Williams Norman (“BWN”) was the lead consultant on a transfer of property from a local authority to Community Gateway Association (“CGA”), the terms of which required CGA to undertake various repair and improvement works. BWN was responsible for preparing and advising on a business plan for CGA, and had failed to take into account the extent of repairs and improvement required before asserting that the business plan was adequate to provide for them.

Akenhead J ruled that BWN had acted negligently, but that CGA had failed to establish that BWN’s breach of duty had caused CGA any loss.
