Countrywide Properties v MDS Civil

Nature of case:
Countrywide had engaged MDS to carry out the ground works for a residential property development. Some time after MDS had completed the work, cracking occurred in three properties and Countrywide brought a claim for breach of contract and negligence against MDS. The court allowed Countrywide’s application to have its claim against MDS amended because the amendments in substance arose out of the same or substantially the same facts as were set out in the initial claim
