Nature of case:
The Defendant sought an adverse costs order against a third party, the EA, in relation to pre-action disclosure applications made by the Defendant against three contractors. The Defendant argued that it would not have incurred the costs but for the failure on the part of the EA to carry out its own disclosure obligations properly.
