Hotel Services Ltd v Hilton International Hotels (UK) Ltd

Nature of case:
In a series of actions relating to the termination of a contract for the provision of minibars in hotel rooms, Hotel Services sought to argue that Hilton International’s action against them should be struck out.  Hotel Services claimed firstly that a default judgment in an earlier action between the parties created an issue estoppel which barred the subsequent action, and secondly that the action was an abuse of process, as they were raising allegations they could have raised in defence to the first action.
