J G Walker Groundworks Limited v Priory Homes (East) Limited

Nature of case:
The claimant groundworks contractor succeeded in obtaining summary judgment of an adjudicator’s decision in its favour.  The defendant developer had argued that, because the contract had been varied, the adjudicator’s jurisdiction did not extend to the varied contract and that what was referred to the adjudicator was about the final account rather than what was due under an interim valuation.  The court rejected both arguments and granted the claimant summary judgment.
