Nature of case:
The Court considered whether security under section 12 (1) of the Party Wall etc. Act 1996 can be required when the works are being carried out on the building owner’s land and not the adjoining owner’s land. Ramsay J. held that an adjoining owner is entitled to request security where the building owner intends to carry out any work under the 1996 Act, whether to his own land or the adjoining owner’s land.
