Nature of case:
A main contractor and sub-contractor were in breach of their contractual obligations and were liable in damages for the cost of replacing steel chilled water pipework in an office building which had been extensively corroded after its insulation had failed. Claim against the sub-sub-contractor, which insulated the pipework, failed on the basis that the installation sub-contract did not incorporate a requirement as such to comply contractually with the employer’s requirements in relation to insulation.
