R (Plan B Earth, Friends of the Earth, London Borough of Hillingdon & others) v. Secretary of State for Transport

These were the high profile environmental law challenges to the Airports National Policy Statement (“ANPS”) which endorsed the principle of expansion of London Heathrow Airport including third runway and sixth terminal. Following a 6 day expedited hearing, the Court of Appeal (Lindblom, Singh and Haddon-Cave LJJ) allowed Plan B Earth’s and Friends of the Earth’s appeals on climate change grounds, and dismissed the appeals of LB Hillingdon and other London local authorities on habitats and strategic environmental assessment grounds.

Charles Banner QC appeared for Arora Holdings Ltd, which participated in the proceedings on behalf of the Arora Group who wish to build the new terminal that is to be part of the Heathrow NWR Scheme. He was instructed by CMS.
