Nature of case:
A declaration was to be issued that a local authority had failed to properly consult local residents before granting planning permission for a major development. However, it was not possible to quash only the permission for the part of the development that the claimant would have objected to had he been consulted, and so there would be no impact on the planning permission as a result of the declaration.
