Nature of case:
Although many terms of a construction contract were negotiated and agreed at an early stage, the contract was not concluded until all the terms were agreed and if this was after 1 May 1998 then the parties were bound by the adjudication provisions of s.108 Housing Grants, Construciton and Regeneration Act 1996.
