Each week, the panel – Charlie Banner QC, Paul G Tucker QC, Mary Cook, Sasha White QC and Christopher Young QC – discuss the latest developments in planning law and policy from the week.

The special guest this week is Robert Rinder, barrister, host of the ITV series Judge Rinder & newly appointed Legal Services Ambassador for Shelter. Robert will be discussing with the panel about how the planning system can address the housing crisis.

Court Judgments of the Week

1. Smith V Castle Point Borough Council & Benfleet Scrap Limited [ 2020] EWCA Civ 1420 a Court of Appeal decision relating to a whether a planning condition to lawfully require the public to have access rights over a road constructed as part of the development.
2. DB Symmetry Limited V Swindon BC & Secretary of State HC&LG [2020] EWCA Civ 1331 a Court of Appeal decision in the meaning & effect of a delegated decision to grant planning permission for the erection of a 5 metre wall around a scrap yard in face of alleged failures to the officer report to consider contamination & intensification.

Appeals of the Week

Appeals of the Week: section 78 inspector decisions on appeals (1) 20th October relating to 112 dwellings in open countryside, at Doddington Park Farmhouse required to facilitate priority heritage works to a group of listed buildings including Grade 1 Doddington Hall, & Grade 11* Delves Hall and Star Barn. Application of NPPF para 11 c ; para 79 (b), 193 & 106.  (2) 19th October for up to 250 dwellings on land outside the settlement boundary of Holmewood, Derbyshire in circumstances where the site was not identified in the emerging development plan which planned to extend the settlement elsewhere. Application of NPPF 11 (d).
