The national and international transport networks and systems
for the generation and delivery of power, water and other basic
services have required some of the world’s biggest projects.
Major infrastructure projects, whether publicly or privately
financed or by a partnership of both, require high quality legal
advice at all stages.
Advice at the procurement stage can help to ensure that
tendering procedures is carried out properly and that robust
contract documentation is in place. Arrangements need to be
made for the avoidance and handling of potential disputes, so that
they do not hinder progress. Members of Keating Chambers are
experienced in advising on the different versions of the FIDIC Form
of Contract and on many other national and international standard
forms. Senior Members of Chambers, principally Queen’s
Counsel, are often appointed to Dispute Boards on international
projects and to engage in mediations and other forms of early
dispute resolution aimed at minimising the effect of any
conflict.
Because of the scale and complexity of major infra-structure
projects, and the sums of money at stake, disputes which do arise
are typically resolved under the auspices of international
arbitration regimes, such as ICC, LCIA, Dubai Chamber of Commerce
or Singapore International Arbitration Centre or other Regional
Centres, such as Hong Kong. Members of Keating Chambers often
appear as advocates in such arbitrations and senior Members
are appointed to Chair or sit as members of arbitral tribunals by
those bodies.
Recent experience extends to the UK motorway system (the M25 and
M6 Toll Road, for example), rail projects, such as the Taiwan High
Speed Railway and London’s Channel Tunnel Rail Link, bridges, such
as Hong Kong’s Tsing Ma Bridge and the UK’s Second Severn Crossing
and airports in the Far East and Europe.
