In every developed or developing society in the world, the basic
necessities of life are produced and delivered to consumers, both
private and commercial, by utilities. Electricity, Gas and
Water are the most essential utilities.
Traditionally, these were supplied by central or local government
and they still are in many countries, but the trend towards
privatisation of the functions of the state means that in some of
the most sophisticated economies, production and delivery is in the
hands of commercial corporations, albeit under statutory
regulation.
The facilities, such as power stations and water treatment
plants, for production and the pipelines for distribution represent
enormous investments and their procurement is a massive task.
Inevitably, disputes can occur with contractors, consultants,
suppliers and consumers in the construction of these facilities and
in the delivery of services.
Avoidance of these disputes, and their resolution, requires
expertise, not merely in the procedures of mediation, arbitration
and litigation (although these are vital) but in the industries
themselves, and the particular forms of contract used, such as the
Institution of Chemical Engineers (IChemE) form in the water
industry. Members of Keating Chambers have experience of
working with professionals in the Electricity, Gas and
Water industries and advising on the efficient handling
of disputes of all kinds, relating to construction, engineering,
process and delivery. As well as offering advice and
providing advocacy services where necessary, a number of the more
senior members of Chambers (usually, but not necessarily, Queen’s
Counsel) sit as arbitrators and are appointed to other kinds of
tribunal, such as Dispute Review Boards. A number are
mediators and alternative forms of dispute resolution have
particular attractions where confidentiality and cost effective
resolution are paramount.
