James Fisher Offshore Ltd v Interact Activity Management Ltd (t/a Offshore Installation Services)

Nature of case:
James Fisher applied for an order that certain passages of an expert’s report submitted by Interact should be redacted.  It was alleged that those passages were not relevant to Interact’s defence as currently pleaded, and Interact did not intend to pursue the mooted amendment to its defence that would make they relevant.

Rejecting the application, HHJ Mackie QC held that the relevance or otherwise of the evidence was a matter for the trial judge.
