PBS v Bester

Citation: [2020] EWHC 223 (TCC)

Bester (Defendant) engaged PBS (Claimant) to design and construct a biomass power plant.  PBS (Claimant) purported to terminate the contract and claimed substantial damages from Bester (Defendant).  Bester (Defendant) denied the legality of PBS’s (Claimant) purported termination and counterclaimed.  The Court found PBS’s (Claimant) purported termination to be unlawful.  Bester (Defendant) lawfully terminated and was entitled to substantial damages.

Tom Owen appeared for the successful Defendant, led by Steven Walker Q.C. and instructed by Rebecca Williams of Watson Farley and Williams.
