PBS v Bester

Bester (Defendant) engaged PBS (Claimant) to design and construct a biomass power plant.  PBS (Claimant) purported to terminate the contract and claimed substantial damages from Bester (Defendant).  Bester (Defendant) denied the legality of PBS’s (Claimant) purported termination and counterclaimed.  The Court found PBS’s (Claimant) purported termination to be unlawful.  Bester (Defendant) lawfully terminated and was entitled to substantial damages.
