Nature of case:
Already reported in BLR, this is the first application of the House of Lords decision in Melville Dundas v George Wimpey to the effect that clause 27.6.5.1 of the JCT Contract (1998 edition) which allowed an employer not to pay a sum without a withholding notice, did not contravene the HGCR Act s.111.  The claimant was successful in its application for summary judgment.
