The New Approach to Evidence: Witnesses v Records

Online

16th June 2021 8:30am

Krista Lee QC joins James Clarke (Bryan Cave Leighton Paisner LLP) and Gary Blackburn (Arcadis) at a webinar on the new approach to evidence. This event will explore the impact of the growing recognition that limited reliance can be placed on witness evidence and the increasing importance of documentary evidence.

The discussion will cover the practical impact of the ICC report on the accuracy of fact witness memory as well as the background to the recent changes to the CPR provisions dealing with witness statements.

The panel will explore the challenges this presents and the role that witness statements still have to play, as well as the way documentary evidence can be managed, both during the life of a project and at the dispute stage, in order to maximise its impact and reduce the need for memory based witness evidence.
