Bellway Homes v Seymour (Civil Engineering)

Nature of case:
The court was required to determine costs following the settlement of a dispute between Bellway, a house builder, and Seymour a contractor engaged to build a road, where the costs far exceeded the amount in dispute.  An adjudicator had awarded Seymour over £1 million, including £400,000 prolongation costs.  Bellway sought to challenge this award, claiming the £400,000 prolongation costs plus additional costs and interest.  Seymour counterclaimed for an additional £11,000 prolongation costs, and for the return of a retention £146,955 held by Bellway.
