Nature of case:
The case concerned claims by 26 owners of property in Derbyshire damaged by a landslip, who sought redress under the Coal Mining Subsidence Act 1991. The Lands Tribunal had determined that the landslip was the result of mining subsidence, thereby establishing the Coal Authority’s liability to pay compensation. 16 claims were settled, but 10 were the subject of the hearing in relation to the amounts payable. The Tribunal had to consider specific issues in relation to depreciation, blight and payments in lieu of repair to buildings.
