Nature of case:
This case considers the costs implications of the Wembley Stadium litigation, where the overall result of the quantum issue had been that Cleveland Bridge had to pay Multiplex £6.154 million, with both sides succeeding on some issues. The Court considered the approach to be taken where one party makes an offer which almost meets the eventual payment, and the other party rejects it outright without any attempt to negotiate. The Court also considered the whether an issue-based or proportionate costs order would be appropriate in this case.
