Nature of case:
Concerns an application by Part 20 CPR defendants for an order under Part II CPR that a Court had no jurisdiction to hear a dispute between sub-contractors and sub-sub-contractors. They argued that there could be no claim for indemnity until the main contract liability was ascertained and that the main contract dispute resolution provisions governed sub-sub-contract disputes.
