Arani & Ors v Cordic Group Ltd

Claim for sums due pursuant to a contract for the sale of a taxi hailing app defended on the basis that the vendors had failed and/or fraudulently failed to disclose that licences necessary to operate the software legally had not been purchased. Application for summary judgment by Claimant was rejected in part. Court determined that terms of the shareholder agreement could not found the basis of a claim for misrepresentation, although the defendant was able to proceed with its claim for fraudulent misrepresentation, which ultimately succeeded at trial.
