Nature of case:
An application for the enforcement of an adjudicator’s decision by the claimant raised questions of the true interpretation of section 105 of the Housing Grants, Construction and Regeneration Act 1996 and also, on the alternative case, of the approach of the court on an application for summary judgment where an adjudicator has jurisdiction as to part but not the whole of the matters referred to him for his decision.
