Sarah Hannaford QC acted for Gloucestershire County Council which successfully defeated the Claimant’s procurement challenge to the amendment of a substantial contract for the construction and operation of an energy from waste plant. At the trial of preliminary issues in the Bristol TCC, the Judge found that the Claimant was not an economic operator which could have successfully pre-qualified, having regard to any selection criteria that could have been lawfully imposed upon it by the Council.
