The Court had to consider whether tender enquiry documents, quotations from a contractor and correspondence passing between the parties constitutes a contract in writing for the purposes of the Housing Grants Construction and Regeneration Act 1996. The Court concluded that as the documents did not set out all the material terms of the contract, in particular any agreed rates of payment, there was no contract in writing.
