A further part of the Wembley Stadium litigation reached the Court of Appeal here on the scope of temporary works and its inclusion within the steelwork sub-contract. The claimant’s appeal against the judge’s finding that design, drafting and fabrication of temporary works did not come within the scope of the steel sub-contract was successful as to design and drafting but not as to fabrication.
