Multiplex Constructions (UK) Ltd v Cleveland Bridge UK Limited and another (no.6)

Citation: EWHC 2220 (TCC)

Nature of case:
This part of the Wembley Stadium litigation concerned quantum, in particular the total sums owed by Multiplex to Cleveland Bridge for work done and materials, and the damages Cleveland Bridge owed to Multiplex for defects and repudiation.  The court considered whether, if a contractor repudiated at a time when the employer had resolved to remove certain of the contractor’s obligations and had already engaged another contractor to perform those obligations, the court should disregard the contractor’s failure to perform those particular obligations when assessing damages.
