SABIC (UK) Petrochemicals Limited v Punj Lloyd Limited

Citation: [2014] EWCA Civ 1288

The Court of Appeal decided there were compelling reasons for making a permission to appeal conditional upon the appellant (“PLL”) paying the judgment debt and also ordered that the respondent (“SABIC”) be awarded security for costs of the appeal, in circumstances where PLL had paid nothing towards the outstanding debt, despite there being no stay of enforcement, and where PLL had also resisted attempts to enforce the debt, despite being well able to make payment.
