Already reported in BLR and noted in Case Law Update in March 2006, this case arose from a design sub-sub-contract relating to a process plant at Sellafield for handling nuclear waste. The issue arose as to the circumstances in which a contracting party could lawfully terminate a contract for delay in performance where the obligation was to complete within a reasonable time.
