Nature of case:
HHJ Gilliland held that an employer could not recover damages against a contractor who had negligently caused a flood.  The Judge found that the employer’s contractual indemnity against the contractor’s negligence was limited by the employer’s obligations to maintain joint names insurance, which it had failed to do.  The Judge granted permission to appeal.
