Willmott Dixon Housing Ltd v Newlon Housing Trust

Nature of case:
Newlon engaged Willmott Dixon as contractor for a mixed used development under the ACA standard form of contract, which stated that disputes were to be resolved by adjudication under the CIC Rules.  Willmott Dixon referred two disputes to adjudication: the first over the sums to which it was entitled following a previous adjudication; and the second over its entitlement to be paid certain other sums withheld by Newlon.  Willmott Dixon applied to CIC for the appointment of adjudicators, and the same Adjudicator was appointed in respect of both disputes.
