Supreme Court grants permission to appeal in Hillside

The Supreme Court (Lord Reed PSC; Lord Leggatt JSC and Lord Stephens JSC) has this week granted Hillside Parks Ltd permission to appeal the widely commented upon decision of the Court of Appeal (David Richards, Singh & Nicola Davies LJJ) in Hillside Parks Ltd v. Snowdonia National Parks Authority [2020] EWCA Civ 440. The case concerns the relationship between multiple planning permissions for development on the same site, and in particular whether the long standing industry practice of obtaining and implementing ‘drop in’ consents to alter elements of a wider development has the effect of precluding further reliance on the original planning permission for that wider development.
