Practice Summary

Lars has a busy practice specialising in Keating’s core practice areas of construction and engineering, infrastructure, energy, PFI projects, arbitration, and technology. He provides advice, drafting and representation at all stages of litigation and ADR.

He has recently been instructed:

  • As sole counsel in the High Court (TCC) to resist an application for specific disclosure by a main contractor.

  • As sole counsel in the High Court (TCC) to seek enforcement of an adjudicator’s decision.

  • As part of the counsel team led by Simon Hughes KC in a £400m ICC arbitration concerning waste management infrastructure in Qatar.

  • As sole counsel to defend a claim against a main contractor in the High Court (TCC) concerning a new-build house warranty.

  • To advise an architectural practice in relation to novel duties owed by principal designers under the Building Regulations.

Lars is experienced in both bespoke commercial contracts, as well as modified and unmodified standard form construction contracts, including JCT and NEC forms.

He is a contributor to Keating on Construction Contracts, and was the winner of the Society for Construction Law’s 2022 SCL Hudson Prize for his paper on recent developments in the law relating to building safety and the Defective Premises Act of 1972.

A former in-house lawyer, Lars worked as in-house counsel at a market-leading fintech startup based in London before joining Keating.

Construction & Engineering
  • Appeared as sole counsel for a main contractor to resist an application for specific disclosure in the High Court (TCC).

  • Instructed to appear at trial for the claimant telecoms provider in a breach of contract dispute in the Birmingham County Court.

  • Advised a major telecoms provider in a dispute with a highways authority in relation to redevelopment works at a major Central London arterial road.
  • Drafted the Defence for a housebuilder in a High Court (TCC) claim relating to a new-build house warranty.

  • Drafted the Defence for an architect in a High Court (TCC) claim relating to subsidence at a residential development.

  • Drafted Particulars of Claim on behalf of the claimant contractor in a dispute concerning non-payment for varied works.

  • Advised and drafted Particulars of Claim on behalf of the claimant homeowners in a dispute concerning defective works and the contractor’s failure to remove equipment following termination of contract.

  • Drafted Particulars of Claim on behalf of the claimant contractor in a dispute relating to sums owed on a re-valuation of renovation works.

  • Drafted the Defence and Counterclaim for a national housebuilder in a dispute concerning defective sub-contracted electrical and plumbing works.
  • Advised a trade union on the settlement of multi-party disputes concerning defective renovation works at its national headquarters.
  • Advised a main contractor in a dispute concerning defectively installed balconies and rainwater ingress at a residential development under a new-build property warranty.
  • Drafted Particulars of Claim for a homeowner in a dispute relating to the collapse of a kitchen extension.
  • Drafted Particulars of Claim for a main contractor in a dispute relating to non-payment for turfing works at a football club.
  • Advised a stonework contractor in relation to a dispute concerning the disputed provenance of marble tiling for a luxury residential development.
PFI/PPP & Commercial

Lars has recent experience of end-of-term PFI disputes, having been instructed as part of the counsel team led by Piers Stansfield KC in a multi-million-pound adjudication arising from a PFI contract in the healthcare sector.

With previous in-house experience, Lars handles a variety of commercial matters. He has recently:

  • Advised a joint venture in a high-value dispute concerning the provision of maintenance services for public sector housing.
  • Acted as sole counsel for a developer in proceedings arising from disputed energy consumption charges at a shopping centre.
  • Acted for a main contractor in an adjudication concerning project delays caused by late installation of electricity cables by a statutory undertaker.

Lars is also frequently instructed on insolvency matters, appearing in court regularly in applications for injunctions to restrain winding-up petitions, and is currently acting for a main contractor in a retention of title dispute between an employer and an M&E supplier concerning mechanical plant delivered to a sub-contractor in liquidation.

International Arbitration
  • Instructed as junior counsel to Simon Hughes KC in a £400m ICC arbitration concerning waste management infrastructure in Qatar.
  • Assisted on a high-value arbitration under LCIA rules.
Adjudication

Lars regularly acts as counsel in adjudications as well as in adjudication enforcement proceedings, including recently:

  • appearing as sole counsel for an electrical sub-contractor in the High Court (TCC), successfully seeking enforcement of an adjudicator’s decision against a developer in a dispute concerning works at a private members’ club and gym.
  • appearing as sole counsel for a sub-contractor in the County Court at Central London (TCC), successfully seeking enforcement of an adjudicator’s decision.
  • acting as sole counsel for the main contractor in an adjudication concerning the delivery and installation of mechanical plant at a pharmaceutical manufacturing facility.
  • acting as junior counsel to Tom Lazur for the respondent developer in a circa £800,000 true value dispute concerning a terminated consultant appointment.
  • acting as junior counsel to Alexandra Bodnar for the main contractor in a final account dispute relating to a luxury residential development.
  • acting for the respondent homeowners in smash and grab and true value adjudications in relation to a final account dispute arising under a JCT Minor Works Building Contract.
  • acting for a developer in a dispute concerning defective electrical works in the fit-out of commercial office space.
Bonds & Guarantees
  • Assisted with drafting Particulars of Claim in a Part 8 claim seeking declarations as to the validity of performance bonds issued in relation to housing developments.
