Hurstwood Development v Motor & General

Nature of case:
Hurstwood, as contractors, sued their insurance brokers when they had to pay a claim by the client for which they were not insured.  The brokers sought to join the consultants whose advice Hurstwood had followed.  The issue was whether the consultants were liable for the “same damage” as the brokers for the purposes of s.1 of the Civil Liability (Contribution) Act 1978.
