Brookhouse Group Limited v Lancashire County Council  [2023] EWHC 2921 (TCC)

The Court of Appeal has granted permission to appeal on all grounds the first instance decision of Mr Martin Bowdery KC (sitting as a Deputy Judge of the High Court) in Brookhouse Group Limited v Lancashire County Council [2023] EWHC 2921 (TCC).

The appeal raises important issues about the scope of the Public Contract Regulations 2015, and in particular the operation of the special time limits provided by Regulation 93 in relation to claims for a declaration of ineffectiveness.

The appellant, Lancashire County Council, continues to be represented by Rhodri Williams KC and Tom Walker. They are instructed by Rob Cathey.
