James Frampton has written ‘How to Get Paid: An Update on Cases on Payment Applications, Payment Notices and Payless Notices’, published in the Summer 2026 edition of the Society of Construction Law Journal.
The paper examines the current state of the law on the validity of payment applications, payment notices and payless notices. It focuses on four key cases: Placefirst Construction Ltd v Car Construction (North East) Ltd, Jaevee Homes Ltd v Mr Steve Fincham (trading as Fincham Demolition), RBH Building Contractors Ltd v Ashley James, Tracy James and Vision Construct Ltd v Gypcraft Drylining Contractors Ltd. James Frampton appeared as counsel in three of the cases.
Drawing on these decisions, the paper considers issues relating to the substance and timing of payment applications and notices and identifies two lessons arising from the developing case law.
The paper was originally presented at a meeting of the Society of Construction Law in London on 9 December 2025. It was subsequently published as SCL Paper 276 in September 2026, following its publication in the Summer 2026 edition of the SCL Journal.
