Nature of case: This was an application by Havant for an order that the arbitrator’s further award be set aside; alternatively declared a nullity; be remitted for reconsideration by him; or that he provide further reasoning for his award. The application was made on grounds that the arbitrator misconducted himself. The court held that the findings of the arbitrator as to the state of affairs that existed at the time the contract was made were not challenged when the matter originally came before the Official Referee. It therefore followed that Havant could not challenge these following the further award.
