Nature of case: The TCC considered whether the adjudicator’s decision as to liquidated damages and extensions of time had been reached in excess of his jurisdiction and in breach of natural justice. The Court held it had not. On the facts, the adjudicator had not decided a case that was not put to him, at most he might have made an error of fact or law but this in itself was insufficient to amount to the decision being reached in excess of his jurisdiction or in breach of natural justice. Further, the adjudicator was under no duty to give reasons for his decision.
