Nature of case: The issue was whether an adjudicator had jurisdiction to produce an enforceable award, where the defendant argued that there had been no reference to adjudication of the interim application but only of the claimant’s ultimate entitlement on the final account. The court considered case law on what constituted a ‘claim’ and a ‘dispute’ for purposes of the reference. In the result, there had been a valid reference and the adjudicator’s award was enforceable.
