On 31 May 2023 the court delivered a verdict to quash the refusal of planning permission marking a pivotal moment in the ongoing legal battle. The Department for Infrastructure, after careful consideration, decided not to defend the application for judicial review brought by Arc21 and a private firm, Indaver. The decision followed the submission of a compelling skeleton argument by the applicants, just days after the scheduled hearing.
