Nature of case:
The Appellant sought to overturn a decision of the TCC before the Court of Appeal.  They argued that an exclusion clause in the agreement between the parties for “Indirect or consequential loss” arising from any defect with their product – a robotic hotel minibar – operated to exclude liability for the cost of removal and storage of the defective products, and the loss of profits from the use of the defective products.
