Nature of case:
This case addressed the circumstances in which a party to a main construction contract could invoke a clause in the subcontract to force a dispute with the subcontractor to be resolved jointly with disputes in the main contract.  The House of Lords confirmed the Court of Appeal decision that it was an implied condition that in order to force joint resolution of the dispute, the main contractor must intend to invoke the dispute resolution process under the main contract and must do so within a reasonable time.
