Skanska Construction (Regions) Ltd v Anglo Amsterdam Corp Ltd

Nature of case:

The contractor appealed against a building dispute award granted in favour of the employer where liquidated damages were deducted due to works remaining incomplete as of the due date. Skanska claimed that clause 17 of the contact provided for “deemed practical completion” when partial possession was taken; Since Anglo was in partial possession of the whole works from a particular date, liquidated damages should not be deducted after that date by virtue of clause 17. Allowing the appeal, the court held that Skanska was merely granted a sub-licence to enter the premises after possession was handed over. Deemed practical completion had therefore taken place on such date.
