Walter Lilly & Co Ltd v Mackay and another

Nature of case:
Mackay sought permission to appeal against the trial judge’s decision that he was liable to pay Walter Lilly more than £2 million in respect of delays caused to a domestic building project.  Mackay argued that the trial judge had erred in his understanding of the notice requirements which were a condition precedent to entitlement, and that the trial judge had further erred in ruling that Walter Lilly’s claim was not a “global claim”.

Aiken LJ refused permission to appeal.
